Question:

Been tied up in a loan mod for half a year now. Litton, our mortgage co., asked for 3 payments in a row, to show that we were serious about loan mod. We made the three payments, but unkown to us they had the wrong home phone # and street address. So when a clerical mistake was made by Litton, they have forclosed on us. It seems, by there admission, that someone took our first loan mod payment and put it toward our actual mortgage payment. That made it look like, on paper, that we didn't make all 3 loan mod payments. When they tried to reach us, they couldn't because of the wrong #'s. Out lawyers also did not know of this untill we called them and let them know what was going on. Our lawyers, whom have already been paid by us, the sum of $3000, are also a problem. They dont answer phone calls or emails from us. So my actual question is: Can we hire new Loan Mod Lawyers, like yourself, and maybe have this turn out good. We also run a business out of our house...an Adult Care Home...so our home is full of 80-100 year old people, so there is a great deal at stake here. Thank you for any input....Robert Bunker

A: Litton can be difficult to work with, they have a reputation for taking a Loang time to approve modifications. Along with that they also have a reputation for doing exactly what you have outlined. have seen a number of cases where Litton has made in house errors and cancelled modifications in the trial payment period. A: Robert, this is a pretty difficult question to answer. I do not want to give you the wrong answer in any way and cause any further complications for you down the road. However, it seems to me that since it has been a clerical error on behalf of Litton, you should be able to aggressively follow up with Litton and let them know about the situation and try to have them make it right. If you go with a new company, you must make sure you understand all the terms and that they know what they are dealing with. You do not want to get stuck with another payment at this time.
