Question: If both spouses are on deed and mortgage in California, can modification be signed by just the husband? Why would the modification company write the loan that way?

A: Unfortunately if the mortgage is in 2 peoples names both must sign the modification agreement. The only exception to this is if a judge grants an exception due to divorce.
